By purchasing products from me (“Artist”), you (“Client”) are agreeing to the following:
This Terms of Use Agreement sets forth the terms and conditions when Client purchases ready to use Live2D models/items ("Assets"). This agreement is made effective between Artist and Client upon purchase of Assets via Etsy, VGen, or Ko-fi.
Artist agrees that Assets are created with the highest quality and care they can provide. Artist warrants that Assets will be original and free from plagiarism to Artist’s best knowledge. Artist also guarantees that the use of generative AI (Artificial Intelligence) is not present in any Assets.
Both Artist and Client agree that confidential information (including, but not limited, to personal information, technical information, marketing plans, payment information, or sensitive business information) may be shared and shall not be disclosed to the public, or any other party, without prior written permission from the owner of the confidential information.
Refunds are not provided as Assets are digital goods that are delivered instantly.
Artist retains copyright, ownership, and intellectual property rights of the Assets. Reselling, redistribution, or modification of Assets is strictly prohibited. Client shall not claim the Assets as their own. Client agrees to credit Artist as creator of Assets.Usage of Assets for AI and/or ML (machine learning) tools, platforms, programs, or training, NFT, blockchain, or other for-profit platforms and purposes, is strictly prohibited.Client is granted the rights to monetized usage of Assets on live streams, recorded content, and promotional purposes social media posts.
Client shall indemnify, and hold Artist harmless from and against all losses, damages, liabilities, actions, judgments, or expenses resulting from Client's acts or omissions or the breach of any representation, warranty, or obligation.
